Clear rules for using Potenting services

1. General – Scope of Application

  • These Terms and Conditions (“Terms”) govern all services, products, and business relationships between Potenting (“we”, “us”, “our”) and any user or customer (“Customer”, “you”).
  • These Terms form an integral part of all agreements concluded between Potenting and the Customer and shall also apply to all future services and offers, even if not expressly agreed again.
  • Any terms and conditions of the Customer or third parties shall not apply unless expressly agreed to in writing by Potenting.
  • Potenting reserves the right to amend these Terms, related policies, and pricing at any time. Changes will be communicated via email or through the Customer’s account, where applicable.
  • No verbal agreements, assurances, or guarantees made by Potenting employees or representatives shall be legally binding unless confirmed in writing.

2. Contract Formation, Duration, and Termination

  • A contract is concluded when the Customer submits an order, registers, or otherwise requests services and Potenting accepts such request.
  • All offers made by Potenting are non-binding and subject to change.
  • The Customer warrants that all information provided is accurate, complete, and up to date and agrees to notify Potenting promptly of any changes.
  • Contracts are concluded for an indefinite period unless otherwise stated.
  • Either party may terminate the contract with 30 days’ notice to the end of the calendar month, unless otherwise agreed.
  • Potenting may terminate the contract immediately for good cause, including but not limited to non-payment, breach of these Terms, illegal use, or activities that threaten system security or stability.

3. Scope of Services

  • The scope of services is determined by the service description available on the Potenting website at the time of order.
  • Potenting may modify, suspend, or discontinue services, particularly free services, upon reasonable prior notice where possible.
  • Potenting endeavors to provide reliable and continuous services but does not guarantee uninterrupted availability.

4. Payment Terms

  • Prices are based on the rates published on the Potenting website at the time of purchase and exclude applicable taxes unless stated otherwise.
  • Invoices may be issued monthly, quarterly, or annually, depending on the service agreement.
  • Late payments may result in service suspension and may incur statutory interest and additional charges.

5. Customer Obligations and Prohibited Use

  • 01. The Customer is solely responsible for all content, data, communications, and activities conducted through the use of Potenting services, including actions performed by third parties using the Customer’s account, whether authorized or unauthorized.
  • 02. The Customer agrees not to use the services, directly or indirectly, for any of the following activities:
    • Any illegal, unlawful, or unauthorized activities under applicable local, national, or international laws or regulations
    • Sending spam, unsolicited bulk messages, or engaging in email abuse, including but not limited to unsolicited commercial communications
    • Phishing, social engineering, spoofing, impersonation, or any attempt to fraudulently obtain sensitive information from individuals or organizations
    • Distribution, hosting, or execution of malware, viruses, trojans, worms, ransomware, spyware, or any other malicious or harmful code
    • Denial of Service (DoS), Distributed Denial of Service (DDoS), brute-force attacks, port scanning, vulnerability scanning, exploitation attempts, or any activity intended to disrupt, damage, or gain unauthorized access to systems, networks, or data
    • Unauthorized access to, interference with, or monitoring of systems, services, networks, or data belonging to Potenting, its customers, or third parties
    • Infringement of intellectual property rights, privacy rights, personal rights, or any other proprietary or legal rights of third parties
    • Hosting, transmitting, or distributing pornographic, obscene, extremist, defamatory, hateful, or otherwise unlawful content
    • Cryptocurrency mining, staking, farming, or any similar resource-intensive activities, unless expressly permitted in writing by Potenting
    • Use of the services in a manner that excessively consumes system resources or negatively impacts the stability, performance, or security of Potenting’s infrastructure or other customers’ services
    • Circumventing, disabling, or interfering with security measures, usage limits, access controls, or technical safeguards implemented by Potenting
  • 03. Potenting reserves the right, at its sole discretion and without prior notice where legally permitted, to suspend, restrict, or terminate services, remove content, or take other necessary technical or legal measures in the event of any violation of this section or applicable laws.

6. Data Security and Backups

  • The Customer is responsible for maintaining regular backups of their data.
  • Potenting shall not be liable for data loss unless caused by willful misconduct or gross negligence.

7. Use by Third Parties

  • The Customer may allow third parties to use the services at their own responsibility.
  • The Customer remains fully liable for all actions taken by third parties using their account or services.

8. Intellectual Property Rights

  • All intellectual property rights related to Potenting services, software, content, and branding remain the exclusive property of Potenting or its licensors.
  • The Customer receives a limited, non-transferable, non-exclusive right to use the services in accordance with these Terms.

9. Liability

  • Services are provided “as is” and “as available”.
  • Potenting shall not be liable for indirect, incidental, or consequential damages, including loss of profit or data.
  • Potenting’s total liability shall not exceed the amount paid by the Customer for the affected service during the last billing period, unless otherwise required by law.

10. Indemnification

The Customer agrees to indemnify and hold harmless Potenting from any claims, damages, losses, or expenses arising from misuse of services, violation of these Terms, or infringement of third-party rights.

11. Governing Law and Jurisdiction

  • These Terms are governed by and construed in accordance with the laws of the jurisdiction where Potenting is registered, excluding conflict-of-law rules.
  • The place of jurisdiction for all disputes shall be the registered office of Potenting, unless mandatory legal provisions provide otherwise.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain valid and enforceable.
